Terms & Conditions

1. Definitions:

“Booking App” shall mean the online programme by virtue of which You have reserved a Car Space within the Car Park;

“Car Park” shall mean the parking facilities situated beneath “The Palace” and “The Victoria Hotel” having its access from George Borg Olivier Sliema;

“Car Space” shall mean the individual slot within the Car Park reserved by You for the parking of Designated Vehicles as per Booking App;

“Designated Vehicles” shall mean the vehicle/vehicles entitled to enter the Car Park and park within the Car Space in terms of the Reservation Agreement;

“Reservation Agreement” means the agreement entered into by You through the Booking App for the reservation of a Car Space;

“Term” shall mean the period of time reserved by You through the Booking App for the parking of Designated Vehicles within the Car Space;

“Terms and Conditions” shall mean these present terms and conditions regulating the use of the Car Space, as well as any further terms contained within the Booking App;

“We” means the operator of the Car Park, namely “AX Hotel Operations PLC” (C40905);

“You” and “Your” shall mean the person entering into a Car Space Agreement;

2. Parking is at Your risk. We shall only be responsible for direct loss or damage resulting directly from Our gross negligence or wilful misconduct to the exclusion of any other liability.

3. Since the Car Park entrance is open to the general public, We cannot guarantee that members of the general public will not enter our Car Park and cause damage to property and/or engage in criminal activity.

4. If a Designated Vehicle sustains damage while in the Car Park, is stolen or any possessions are stolen from it while it is in the Car Park, You should immediately inform either a member of staff at the Car Park or otherwise notify on 21333444; although the responsibility to file any police report will be of the car park patron. The hotel is unable to release any CCTV footage to patrons. Such footage will only be given upon request to police authorities.

5. a. You are to:

  • comply with all signs, directions and orders in the Car Park;
  • park within the limits of the Car Space (none of the vehicle’s tires should be on or outside the Car Space markings);
  • park only Designated Vehicles within the Car Space;
  • not park within any other area within the Car Park not being the Car Space, irrespective of designation of area;

5. b. The penalty payable for breach of sub-clause (a) above shall be as follows:

  • (i) First breach: €25.00;
  • (ii) Second breach: €100.00;
  • (iii) Third breach: immediate cancellation of contract and relinquishment of Space;

5. c. You accept that we shall be fully entitled to refuse access to the Car Park and Space pending the payment of any penalty imposed as aforesaid.

5. d. In the event of any breach of this Clause and in conjunction with any penalty due, You accept that We are fully entitled to remove the vehicle at Your sole risk and expense using whatever method we consider appropriate (even if, as a consequence, damage is caused to the vehicle) to the extent that is reasonably necessary for the purposes of safety to persons or property, or to avoid obstruction at the Car Park.

6. By parking a Designated Vehicle in the Car Park, You consent to us capturing, using and processing the vehicle and personal details via CCTV for enforcement purposes. The number and location of the cameras shall be at Our discretion.

7. If the Car Park and/or the equipment in the Car Park is damaged by You, a Designated Vehicle, its contents or the passengers in the vehicle then, except where the damage arises as a direct result of our gross negligence, we will seek to recover the cost of that repair and associated administration costs from You.

8. Unless asked by a member of our staff not to do so in the case of emergency, please ensure that Your vehicle is left securely locked with all windows securely closed and any vehicle alarm, steering lock or similar device fitted is engaged.

9. Any possessions left in a vehicle are left entirely at Your risk.

10. For safety and security reasons You are not entitled to remain in a vehicle in the Car Space or elsewhere in the Car Park except for the purposes of parking in or removing a Designated Vehicle from the Car Space. The Car Space’s sole permitted use shall be exclusively that of parking a Designated Vehicle within it.

11. We are entitled to regard as abandoned any Designated Vehicle left in the Car Park following expiry or termination of the Reservation Agreement and engage and/or permit the removal of the said vehicle in any lawful manner.

12. You must not tow any vehicle into the Car Park except as part of the services offered at the Car Park by persons authorised by Us and no work on and no cleaning of vehicles by you or your agent is permitted in the Car Park.

13. In the event of vehicle breakdown, you must contact a hotel team member on 21333444 to ensure that your vehicle removal or repair is organised without causing disruption, damage or danger to any other person or property in the Car Park.

14. You are not allowed to dispose of any items or drop litter in the Car Park. Please place any rubbish/litter in the bins that are provided or take it away with you when you leave the Car Park.

15. You are not allowed to pour petrol, or any other fuel, into a vehicle whilst it is in the Car Park. You are also not allowed to take petrol, or any other fuel, out of your vehicle whilst it is in the Car Park.

16. Smoking is forbidden within both the Car Park and the immediate vicinity of the Car Park.

17. Anti-social behaviour will not be accepted in our Car Parks. You should furthermore not take photos or carry out any filming within the CarPark .

18.Refund/Cancellation Policy

Refund/Cancellation Policy

We strive to provide our customers with high-quality services and a seamless experience. Nonetheless, our policy allows for cancellation and refunds, as follows:

Cancellations & Refunds: Our policy allows cancellations in respect of contracts with a minimum length of one (1) year. Refunds will only be considered if the car park access card is duly returned to the company along with a declaration that the renter is renouncing their tenancy rights.

Exceptions: Any other contracts entered for a lesser period cannot be cancelled and / or refunded.

Dispute Resolution: In the event of a complaint or dispute, we encourage you to contact our administrator directly at [email protected] If your complaint is not resolved directly with us, you have the right to refer the matter to the Malta Competition and Consumer Affairs Authority (“MCCAA”) through their Online Dispute Resolution (“ODR”) Platform, accessible at https://mccaa.org.mt/home/complaint.
